What is a break clause?

A clause that let either side end a fixed term tenancy early. In England they no longer do anything, because fixed terms ended on 1 May 2026.

Under the old assured shorthold system, a twelve month tenancy with a six month break clause was the standard shape. Neither part of that survives.

Now the tenancy is periodic from the start. The tenant gives two months’ notice whenever they like and you use a possession ground. A break clause in an old agreement is simply spent.
